Have you been involved in a pedestrian accident?
Have you been involved in a pedestrian accident? Accident Law Group is a personal injury law firm serving Arizona, and we understand the impact these incidents can have on injured people and their families.
Pedestrian accidents often occur when a person is exiting public transportation, such as a bus or light rail, or simply crossing the street. Even if you were out at night or crossing the street away from the crosswalk, an injured pedestrian may still have a claim and can talk with a car accident attorney about it. Under Arizona law, a pedestrian crossing outside a crosswalk generally must yield to vehicles (A.R.S. 28-793), but every driver must still use due care to avoid hitting a pedestrian (A.R.S. 28-794). Any share of fault the pedestrian has generally reduces the compensation rather than ending the claim (A.R.S. 12-2505).
Our team of dedicated pedestrian accident lawyers is here to provide the legal representation you need to pursue justice.
Even the slightest contact between a car and a pedestrian can result in serious injury, let alone a direct impact. Pedestrian accidents are hazardous because pedestrians lack the protection that vehicles offer.
While people riding bicycles may wear protective gear such as helmets and gloves, pedestrians are generally even more vulnerable to injury, making bicycle and pedestrian accidents similarly dangerous but distinct in their legal handling. Drivers who are distracted, speeding, or not watching for people on foot cause many pedestrian crashes, and where the pedestrian was crossing can affect how fault is shared.
When a pedestrian is hit by a car, it often knocks the pedestrian to the ground, making the injured victim highly vulnerable to broken bones, catastrophic injury, or even a brain injury. Hospitals don’t always find brain injuries, which may not show up for days after the first blow. Common pedestrian accident injuries include fractures, spinal cord damage, traumatic brain injuries, and soft tissue harm, all of which require immediate medical attention.
It is important to follow up with experienced doctors to support your recovery after a pedestrian vs. car accident. Furthermore, before speaking with the insurance company, it is important to consult an experienced accident lawyer who regularly handles car and pedestrian accident cases.
The insurance company will begin building its case against you immediately, so you must protect your health and legal rights as a pedestrian accident victim.
Our personal injury attorneys regularly handle pedestrian accident cases, and we understand how serious these injuries can be.
Whether it’s a car accident, truck accident, motorcycle accident, bus accident, or trucking accident involving pedestrians, our law firm is equipped to provide comprehensive legal representation.
If the incident resulted in wrongful death, our wrongful death attorneys can guide families through the process of seeking compensation for their loss.
What is a Pedestrian Accident Lawyer?
A pedestrian accident lawyer is a personal injury attorney who helps people who were hurt while walking or crossing the street. Our attorneys can help clients navigate the legal process, including filing a personal injury claim or lawsuit against the person who caused the injury and negotiating a settlement. They can also provide guidance on the amount of compensation that may be available, including compensatory and potentially punitive damages, and assist with coordinating medical bills and treatment, handling insurance claim(s), and providing other forms of support.
When a vehicle hits a pedestrian, it can cause bodily injury, severe injuries, and even death. Pedestrian accidents are a significant problem in Arizona. According to the Arizona Department of Transportation, Arizona ranks among the top states in the U.S. for pedestrian fatalities.
Local news has reported that the number of fatal pedestrian accidents in the state has been consistently high, with many of these pedestrian deaths occurring in urban areas and at night. It is important to be aware of the risks and take precautions when walking or crossing the street to prevent pedestrian injury.
Pedestrian accident lawyers at our firm also handle related cases, such as premises liability cases in which a property owner’s negligence contributes to a fall, and construction accidents affecting pedestrians. For instance, if a pedestrian is injured in an accident caused by poor sidewalk maintenance, it might overlap with slip-and-fall claims. Similarly, medical malpractice could arise if improper treatment is provided after the accident, exacerbating the harm. Our personal injury lawyers are versed in personal injury law to ensure all angles are covered in your pedestrian accident claim.
Common Causes of Pedestrian Accidents in Arizona
Pedestrian accidents in Phoenix and throughout Arizona often stem from driver negligence, such as distracted driving, speeding, or failure to yield at crosswalks. Where there is no working traffic signal, Arizona law generally requires drivers to yield to a pedestrian crossing in a crosswalk (A.R.S. 28-792). Other factors include impaired driving, poor nighttime visibility, and other violations of traffic laws.
For example, in auto accidents involving pedestrians, drivers may not see walkers due to blind spots or inclement weather. Truck accidents and semi-truck incidents pose even greater risks due to the size and weight of the vehicles, potentially leading to catastrophic injury or wrongful death.
Bicycle accidents and motorcycle accidents can also involve pedestrians if multi-party collisions occur. In urban areas like Phoenix, bus accidents are common near stops where pedestrians congregate.
Our attorneys have seen cases in which construction accidents or premises liability issues, such as uneven pavement, put pedestrians in harm’s way.
Types of Injuries in Pedestrian Accident Cases
Pedestrian accident victims frequently suffer from a range of injuries, including:
- Broken bones and fractures
- Traumatic brain injuries
- Spinal cord damage
- Internal injuries
- Emotional trauma and long-term disability
These common pedestrian accident injuries can lead to extensive medical bills, lost wages, and ongoing rehabilitation. In severe cases, they result in wrongful death, leaving families to pursue claims for funeral costs, loss of companionship, and other damages. As your pedestrian accident lawyer, we work to pursue compensation for economic and non-economic losses. In rare cases, Arizona law also allows punitive damages, which generally require clear and convincing evidence that the at-fault person acted with an “evil mind” (Linthicum v. Nationwide Life Ins. Co., 1986).
What to Do After a Pedestrian Accident
If you’ve been in a pedestrian accident, prioritize your safety and seek medical attention immediately, even if injuries seem minor. Document the scene, gather witness information, and report the incident to the police. Avoid speaking to insurance adjusters without consulting an accident lawyer first. Contact Accident Law Group for a free consultation—our personal injury attorneys will review your pedestrian accident case and explain your options.
As an accident victim, you may be entitled to compensation through a personal injury claim. Our law firm handles everything from investigating the accident to negotiating settlements or representing you in court. We also assist with related claims, such as those involving motorcycle accidents or truck accidents that impact pedestrians.
How Insurance Applies to Pedestrian Accidents in Arizona
In Arizona, a fault-based state, compensation for pedestrian accident victims typically comes from the at-fault driver’s liability insurance first. A pedestrian who was crossing outside a crosswalk or walking at night may still have a claim if the driver’s negligence contributed to the crash, though any share of fault the pedestrian has generally reduces the compensation.
Key insurance policies that may cover your losses include:
- At-Fault Driver’s Liability Insurance — This is the primary source. For policies issued or renewed since July 1, 2020, Arizona law requires minimum bodily injury liability coverage of $25,000 per person and $50,000 per accident (A.R.S. 28-4009). It pays for your medical bills, lost wages, pain and suffering, rehabilitation costs, and other damages if the driver is found at fault (e.g., distracted driving, speeding, or failure to yield). Higher limits or commercial policies (trucks, buses) often provide more substantial recovery.
- Your Own Uninsured/Underinsured Motorist (UM/UIM) Coverage — If the at-fault driver has no insurance (uninsured), flees the scene (hit-and-run), or their policy limits are too low to cover your damages (underinsured), your own auto insurance policy’s UM/UIM coverage can step in. Arizona insurers must offer UM/UIM when selling liability policies, though it’s optional to purchase. Depending on the policy language, a pedestrian may be covered under a household auto policy’s UM/UIM even if they weren’t in a vehicle at the time of the accident. This coverage helps bridge gaps and can include bodily injury up to your policy limits.
- Other Potential Sources — In rare cases involving commercial vehicles or government entities, additional policies may apply. Under Arizona’s pure comparative fault rule, a pedestrian who was partly at fault can generally still recover, but the compensation is reduced by the pedestrian’s percentage of fault (A.R.S. 12-2505).
Types of Losses Typically Covered:
- Economic damages — Medical expenses (past and future), lost wages/income, property damage, and ongoing care.
- Non-economic damages — Pain and suffering, emotional distress, loss of enjoyment of life.
- Wrongful death — Funeral costs, loss of companionship, and support for surviving family.
Arizona generally allows two years to file a personal injury lawsuit (A.R.S. 12-542). Claims against a city, county, or the state follow different rules: a written notice of claim generally must be filed within 180 days (A.R.S. 12-821.01), and a lawsuit generally within one year (A.R.S. 12-821). It can help to have these dates reviewed early.

Step-by-Step Guide to the Pedestrian Accident Claims Process
Filing an insurance claim after a pedestrian accident can feel overwhelming, but understanding the steps helps you stay in control. Here’s what to expect:
- Seek Immediate Medical Care — Prioritize your health. Even if injuries seem minor, get evaluated right away to document them and support your claim.
- Report the Accident to Police — Call 911 or local law enforcement for an official report. This creates critical evidence of the incident, including fault details.
- Gather and Preserve Evidence — Collect photos of the scene, injuries, vehicle damage, road conditions, and signage. Obtain witness contact information, the driver’s details (license, insurance), and any available video footage.
- Avoid Early Discussions with Insurance Companies — Do not give recorded statements, accept quick settlements, or sign anything without consulting an attorney. Insurers often start building a case against you immediately.
- Notify the Relevant Insurer(s) — Your attorney typically files the claim with the at-fault driver’s liability insurer (third-party claim). If UM/UIM applies, a claim may also go to your own insurer.
- Submit Documentation and Respond to Requests — Provide the police report, medical records, bills, wage loss proof, and other evidence. The adjuster will investigate liability and damages.
- Negotiate the Settlement — Insurers often make low initial offers. Your attorney can respond with evidence of your injuries and losses.
- Resolve Disputes or File a Lawsuit if Needed — If the claim is denied, delayed, or undervalued, your lawyer can keep negotiating or file a lawsuit before the deadline, which is generally two years for claims against private parties and shorter for claims against government entities. Many cases settle without a trial.
Timely action preserves evidence, meets deadlines, and prevents insurers from exploiting delays. Accident Law Group handles every step so you can focus on recovery.
Common Challenges and Pitfalls in the Insurance Claims Process
Insurance companies prioritize profits, which can lead to hurdles for pedestrian victims in Arizona:
- Delays in Investigation or Response — Adjusters may drag out the process to pressure you into accepting less.
- Lowball Settlement Offers — Initial offers frequently undervalue claims by ignoring future medical needs, long-term pain, or non-economic damages.
- Denials or Disputes Over Liability — Insurers may blame the pedestrian (e.g., via comparative negligence) or claim insufficient evidence, especially in hit-and-runs or low-visibility cases.
- Challenges with UM/UIM Claims — Coverage gaps, disputes over policy limits, or strict proof requirements for hit-and-runs can complicate recovery.
Practical Tips to Avoid Mistakes:
- Never give a recorded statement without legal advice—statements can be used against you.
- Follow all medical treatment plans; missing appointments weakens causation proof.
- Avoid social media posts about the accident or your activities—insurers monitor for inconsistencies.
- Don’t accept early cash offers before knowing your full damages.
- Keep all correspondence and document every interaction.
A pedestrian accident lawyer can help you respond to insurers and keep the focus on the evidence.
The Role of Documentation in Supporting Your Insurance Claim
Strong documentation is the foundation of a successful claim—it proves liability, the extent of your injuries, and your damages. Without it, insurers can minimize or deny your case.
Key records to collect and preserve:
- Official police/accident report
- Medical records, bills, and receipts (from initial treatment through ongoing care)
- Photos and videos of the accident scene, your injuries, vehicle positions, road conditions, weather, and signage
- Witness names, contact info, and statements
- Proof of lost wages (pay stubs, employer letters, tax records)
- All correspondence with insurance companies or adjusters
- A personal injury journal noting daily pain levels, limitations, and emotional impact
Organize everything chronologically. Your attorney uses this evidence to build a compelling demand package, counter low offers, and strengthen negotiations or court arguments. Start collecting immediately—evidence can disappear quickly.
Possible Alternative Avenues for Compensation
If insurance coverage falls short (e.g., no UM/UIM, low limits, or denial), other options may help:
- Government Programs — Arizona’s AHCCCS (Medicaid) can cover medical costs for eligible low-income victims (apply via Health e-Arizona PLUS).
- Disability Benefits — Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) for long-term or permanent disabilities.
- Workers’ Compensation — If the accident occurred during work-related walking or duties.
- Other Sources — Community aid, crowdfunding, or victim assistance funds in severe cases.
Accident Law Group can review these options with you.
Pedestrian Accident FAQ
Here are plain answers about pedestrian accident claims in Arizona, how insurance often works, and when it may help to talk with an Accident Law Group attorney.
Prioritize safety and medical care first, even if injuries seem minor at the scene. When you can, get a police report, note the driver’s information, and gather photos or witness contacts if it is safe to do so. Avoid recorded statements or quick settlement papers until you understand your options. Accident Law Group can walk through next steps in a free consultation — call 602-333-3333 when you are ready.
Many pedestrian claims still turn on whether a driver’s negligence contributed to the crash — including distraction, speeding, or failure to yield. Crossing outside a marked crosswalk or walking at night can raise comparative-fault questions under Arizona law, but those facts alone do not automatically end a claim. Every situation is different; a careful review of the scene, lighting, and vehicle conduct matters. This is general information only — speak with a lawyer about how Arizona law may apply to your facts.
Arizona is an at-fault state, so the at-fault driver’s liability coverage is often the first place a pedestrian claim looks. Household auto policies may also include uninsured or underinsured motorist (UM/UIM) protection that can apply to pedestrians in some situations — including hit-and-run or low-limit cases — depending on the policy. Commercial policies (for example, some trucks or buses) can change the available coverage picture. An attorney can help identify which policies may be involved without guessing at outcomes.
Uninsured / underinsured motorist coverage is optional coverage Arizona insurers must offer with liability policies. When an at-fault driver has no insurance, flees the scene, or carries limits too low for the harm, UM/UIM on a household auto policy may help fill gaps if that coverage was purchased and applies to your claim. Pedestrians are sometimes covered under a household policy even though they were not inside a vehicle at the time — but policy language controls. Bring your declarations page to a consultation if you have it; we can help you read it carefully.
Many Arizona personal injury claims against private parties are subject to a two-year statute of limitations, counted from the date of the accident. Claims involving government entities can involve shorter notice deadlines. Waiting can make evidence harder to preserve and may limit options. Deadlines are fact-specific; contact Accident Law Group early so timing can be reviewed for your situation. Call 602-333-3333 for a free consultation — there is no obligation to hire us.
Claims often involve economic losses you can document with bills or wage records — such as medical treatment, future care that is reasonably needed, and time away from work — and non-economic harms such as pain, emotional distress, and loss of enjoyment of life. In fatal cases, surviving family members may have separate wrongful-death questions. No form or web page can assign a dollar value to your case; the full picture belongs in a careful review of medical proof, liability, and available insurance.
Insurers investigate liability and damages with an eye toward limits and comparative fault. Arguments about where you crossed, visibility, clothing, or phone use are common — especially when evidence is incomplete. Strong documentation (police report, photos, medical follow-up, and a clear timeline) helps keep the focus on the full story. You do not have to navigate adjuster questions alone; we can explain what typically helps and what can wait until you have advice.
It can help to talk with us soon after medical evaluation, when an adjuster asks for a recorded statement, when a hit-and-run or low-limit policy is involved, or when injuries may involve brain, spine, or long recovery. We focus on clear communication and careful documentation so you can concentrate on healing. Accident Law Group offers a free consultation so you can share what happened and ask questions before deciding on next steps. Call 602-333-3333 — there is no fee unless we recover for you.

I was hit by a semi on valentine's day in 2022. Settled back in 2025. Got way less then my injuries 6 herniated discs. 3 partial torn ligaments. Post concussion syndrome (TBI) and 2 hernia's and now I use a cane when my back flares up. I truly feel like they dropped the bag and accused of being over treated. They weren't there like my fiancee seeing me in pain or sleepless nights cause the neck pain was so excruciating I had trouble sleeping. Some the people we're nice. Others that won't be named but are the face of the law firm came off as rude and impudent. I felt betrayed somewhat in my time of need. Going to and from pain management and physical therapy being out of work for almost 4 Months. Draining my savings and inheritance over those years. It's truly sad trying to trust someone when your in your time of need. I had 140k in medical bills and only got cut a check For 45k.... yeah go somewhere else. I wish I did. I now do daily regiments of foam roller, tens unit, stretching, my cane. Ice or heating pad. I try to play with my 5 year old now and sometimes I can keep up. BUT STILL ALWAYS IN PAIN. Come February it'll be 5 years from that accident.Posted on Google![]()
